During the hearing of the Sambhal Masjid case in Allahabad High Court, during the hearing of the revision petition of the management committee Jami Masjid Sambhal, ASI advocate Manoj Kumar Singh raised objection that the name of the mosque is written as Juma Masjid in the ASI documents. The agreement made between the Secretary of State and the Mutawalli of the mosque in 1927 also mentions Juma Masjid.

He said that the petition is filed in the name of Jami Masjid. During the hearing on the last date, Justice Rohit Ranjan Agarwal had asked senior advocate SFA Naqvi what the real name is, to which he said it is Jama Masjid. He will file a revision petition. But no revision petition came. The question still remains whether Sambhal Masjid is Jama Masjid or Jami Masjid or Juma Masjid.

He said that if the petition is filed with the wrong name and the name is not revised, then the petition can be dismissed on this basis. This issue can be raised again in the next hearing.

Sambhal Masjid name dispute: Jami, Jama or Juma?

At present, the Advocate General has called the Sambhal Mosque a disputed mosque structure. Harishankar Jain had also made a similar demand and said that it should be called a disputed structure and not a mosque. The dispute is going on in the subordinate court whether the alleged mosque is a temple or a mosque.

The Allahabad High Court has accepted the oral argument of the lawyer of the Hindu litigants, in which it was said to refer to the Sambhal Shahi Jama Masjid as a ‘disputed structure’. However, in the written order passed by Justice Rohit Ranjan Agarwal, it has been called a ‘disputed mosque’.

Earlier on Tuesday, the court was hearing the petition of the Masjid Management Committee, in which permission was sought for whitewashing and cleaning of the mosque. The mosque committee had approached the High Court on February 27. When the court was pronouncing the order, senior Supreme Court lawyer Hari Shankar Jain, representing the Hindu side, had asked the bench of Justice Rohit Ranjan Agarwal to term the mosque as a ‘disputed structure’.

The court accepted his request and directed his stenographer to use the term ‘disputed mosque structure’ in the order passed on Tuesday.

Jain argued that it is a legal process and when there is a case about the disputed structure, it cannot be called a mosque or anything else till the decision of the court. Advocate General Arun Kumar Mishra submitted before the court that law and order was maintained in and around the disputed mosque structure by the state authorities.
