Madhya Pradesh High Court: While hearing a case, said, no husband will tolerate obscene conversation with his friends after marriage

Recently a case came before the Madhya Pradesh High Court where the wife had alleged that the husband commits violence against her and also accused him of demanding dowry of Rs 25 lakh. On the other hand, the husband had alleged that his wife does obscene chatting with her male friends on mobile. The Madhya Pradesh High Court recently dismissed the appeal of a woman against the order of the family court, in which her husband’s divorce petition was allowed on the ground of cruelty against her.

The husband had alleged that his wife is talking to her male friends about their personal life, the wife is chatting with her male friends on the phone regarding the physical relationship of the husband and wife. A bench of Justices Vivek Rusia and Gajendra Singh gave the verdict on this.

What did the court say?
The court said that no wife or husband can have obscene conversations with their friends after marriage. The court said, no husband will tolerate that his wife is doing such obscene chatting on her mobile. After marriage, the husband and wife have the freedom to chat with whomever they want on their phone, but in this thing, care should be taken about what kind of things you are talking about.

The court said, the level of your talk should be decent. Also, the court said, the level of your talk should be more decent when you are talking to a man being a woman or talking to a woman being a man. Your words should be such that your partner does not object to it. The court said that if despite objection, the husband or wife continues to talk like this, then it will definitely become a reason for mental cruelty for the other partner.

How did the dispute between the couple start
This couple got married in the year 2018. The husband cannot hear partially and this information was given to the wife before marriage. However, the husband alleged that soon after marriage, the wife started misbehaving with his mother and after one and a half months she left her in-laws’ house. The husband also allegedly alleged that the wife used to chat with her old lover on mobile after marriage. The husband said, the conversation between the two on WhatsApp is vulgar.

The wife put forward her side on the allegations made by the husband, saying that the wife said that she has no relation with the men with whom she is being accused of chatting. She also claimed that the husband had hacked her mobile phone and he himself had sent messages to those 2 men to create evidence against her.

What did the wife say?

The wife further argued that her husband had violated her right to privacy by extracting chats from her phone. The wife also accused the husband of beating her and demanding dowry of Rs 25 lakh. However, the High Court found that the woman’s father himself had admitted that his daughter had a habit of talking to male friends.

The family court found that Ex.A/4 and A/6, the printout of chatting of this appellant with Vinod and others, is not a civil conversation. There is no retaliatory action by way of FIR or complaint of domestic violence etc. against the respondent, which establishes that the allegations of the respondent against the wife are correct. Hence, the court fully agreed with the decision of the family court to grant divorce to the man.
