BJP MP Nishikant Dubey’s comments on the Supreme Court and CJI Sanjiv Khanna have created a ruckus. Opposition parties are attacking the government and many allegations are being made. On the other hand, a petition has been filed in the Supreme Court to run a contempt case. Meanwhile, some BJP leaders have come out in support of Nishikant Dubey, if not openly. After Kailash Vijayvargiya, Chief Minister Himanta Biswa Sarma has targeted the Congress. He has given advice by reminding the opposition and statements of the Congress in the old days.
The CM said that the BJP has always maintained the independence and dignity of the judiciary. Assam Chief Minister Himanta Biswa Sarma shared a post on Instagram and wrote that the Bharatiya Janata Party has always maintained the independence and dignity of the judiciary as the cornerstone of India’s democracy.
He wrote that recently, BJP President JP Nadda has reaffirmed this commitment by distancing the party from the comments made by MP Nishikant Dubey regarding the Supreme Court. The CM further wrote that Nadda emphasized that this is a personal opinion and does not reflect the party’s stand. He reiterated the BJP’s deep respect for judicial institutions. BJP maintains this principled position
Congress always insulted the judiciary – Sarma
Himanta Vishwa Sarma attacked the Congress and said that it is appropriate to investigate the historical relationship of the Congress party with the judiciary. Congress has publicly criticized respected members of the judiciary on many occasions. Referring to some judges, CM Sarma wrote on X that Justice Deepak Mishra Congress and other opposition parties brought an impeachment motion against him without concrete evidence.
Ayodhya case verdict has faced strong criticism after several historic decisions. Justice Arun Mishra was targeted for his judicial decisions and alleged proximity to the executive despite performing constitutional duties.
Justice DY Chandrachud: Faced unfair scrutiny over his interpretations in important cases, especially when the decisions were not in line with some political expectations. Justice S. Abdul Nazeer: His appointment as Governor of Andhra Pradesh post-retirement was criticised by the Congress, alleging that it threatened judicial independence, even though similar appointments have been made in the past.
Criticisms should be based on principle, not convenience: CM Sarma
This pattern reflects the mindset within the Congress party to challenge the credibility of the judiciary when decisions do not suit their politics. Such selective criticism undermines the sanctity of judicial processes. Respecting the judiciary should not depend on the favourability of its decisions. Finally, while the BJP continues to respect the role of the judiciary fairly, it is important for opposition parties to consider their approach, ensuring that criticisms are based on principle rather than convenience.
