New Delhi: Jamiat Ulama-e-Hind President Maulana Arshad Madani has expressed a strong reaction to the state government’s decision to implement Uniform Civil Code in Uttarakhand. Maulana Arshad Madani said on UCC that we do not accept any law which is against Shariat, because a Muslim can compromise with everything, but not with Shariat. He said that the truth is that a follower of any religion cannot tolerate any kind of undue interference in his religious activities.
‘UCC denies the fundamental rights of the Constitution’
Maulana Madani said that today Uniform Civil Code has been brought in Uttarakhand, in which Scheduled Tribes have been exempted from the new law under Article 366A Chapter 25A Subsection 342 of the Constitution. He said that it has been argued that their rights have been protected under Article 21 of the Constitution, in such a situation, when they can be kept away from this law, then why should we provide religious freedom under Articles 25 and 26 of the Constitution? Can’t it be given? He said that if seen, the Uniform Civil Code negates the fundamental rights.
‘Will decide on legal action after review’
Maulana Arshad Madani said, ‘Our legal team will review the legal aspects of the bill after which a decision on legal action will be taken. The question is not about the personal law of Muslims but about maintaining the secular Constitution of the country in the present situation, because India is a secular country and secularism in the Constitution means that the country has no religion of its own. Maulana Madani said that Our country is a multi-cultural and multi-religious country, this is also its specialty, hence one law cannot operate here.
‘Family laws of Muslims are not laws made by humans’
Maulana Madani said, ‘We want to make it clear that our family laws are not laws made by humans. They are created by the Quran and Hadith. There can be jurisprudential debate on this, but we have no disagreement on the basic principles. It seems absolutely right to say that the implementation of Uniform Civil Code is a well-planned conspiracy to attack the religious freedom of the citizens. Communal forces want to keep the country’s minorities, especially Muslims, in fear and anarchy by raising new religious issues every day.
