Chhattisgarh: A food inspector in Bilaspur was dismissed due to a 22-year-old case. The court cancelled his dismissal and said that it was wrong to remove him from the job on the basis of a case filed while he was a minor.

A food inspector in Bilaspur, Chhattisgarh, was dismissed due to a 22-year-old case. The inspector approached the court seeking justice. The court heard his arguments and overturned his dismissal order. The court stated that the inspector was a minor when the case was filed.

This case originated in Chhattisgarh, where Prahlad Prasad Rathore, a resident of Pendra Road, lost his job due to a childhood fight with a neighbor. He was dismissed in 2024 based on a case filed in 2002. He was a minor in 2002. Prahlad Prasad Rathore served in the Indian Navy for five years.

Appointed as a Food Inspector in 2018
On August 30, 2018, Prahlad Prasad was appointed as a Food Inspector through the ex-servicemen quota. After this, he served and performed his duties with distinction, but on March 15, 2024, he was dismissed from service based on a police verification report. It was stated that Prahlad Prasad had previous criminal cases against him, making him ineligible for government employment.

He then approached the High Court. He filed a petition, but the single bench dismissed his petition in January 2025. He then appealed to the Division Bench. He stated that a case had been filed against him in 2002, which had been dismissed in 2007. At that time, the Food Inspector was a minor, and the case stemmed from a minor dispute with a neighbor.

The appeal also stated that no investigation had been conducted in the case filed in 2002, nor had any convictions been made by the court. However, when the dismissal was made on this basis, his side was not heard and he was dismissed without any explanation. He stated that his character and conduct were excellent during his service in the Indian Navy.

The division bench of Chief Justice Ramesh Sinha and Justice Bheedi Guru stated that the grounds on which he was dismissed from service were not correct. A case was filed against him when he was a minor, which was settled in 2007, and he resumed service in 2018. Therefore, declaring his character ineligible based on an old case is arbitrary. He is exempt from all disqualifications under the Juvenile Justice Act.
