Jammu and Kashmir: A special NIA court in Budgam district has issued a non-bailable warrant against Hizbul Mujahideen chief Mohammad Yusuf Shah alias Syed Salahuddin, who is currently residing in Pakistan.

A special NIA court in Budgam district of Jammu and Kashmir has issued a non-bailable warrant against Hizbul Mujahideen chief Mohammad Yusuf Shah alias Syed Salahuddin, who is currently residing in Pakistan. The court has also directed the police to arrest him.

Militant leader fled to Pakistan
Salahuddin, who contested the assembly elections in the Valley in 1987, fled to Pakistan in 1990 when militancy erupted in Kashmir. The special court in Kashmir said that the Hizbul Mujahideen chief is evading arrest and a non-bailable warrant should be issued for his arrest.

Warrant issued in terrorism-related case
A non-bailable warrant has been issued against Hizbul Mujahideen chief Mohammad Yusuf Shah, also known as Syed Salahuddin, who resides in Pakistan, in a terrorism-related case registered by the police in 2012.

Case heard under these sections
The court of the special judge designated under the National Investigation Agency (NIA) Act issued this directive after hearing the case registered under various provisions of the Unlawful Activities (Prevention) Act (UAPA) and Section 506 of the Ranbir Penal Code (RPC). The Ranbir Penal Code was the specific criminal legal code for Jammu and Kashmir until 2019, similar to the Indian Penal Code.

Accused evading arrest
The court stated that the investigating officer has collected sufficient evidence that prima facie links Shah to various offenses under Sections 13, 18, 20, and 39 of the UAPA, related to threatening sovereignty, terrorist conspiracy, and involvement in terrorist activities. The court further stated that the accused is evading arrest, therefore, a non-bailable warrant has been issued against Syed Salahuddin, and the Jammu and Kashmir Police have been directed to arrest him in connection with the FIR.

Declared a terrorist in 2020
It is worth noting that Salahuddin fled to Pakistan in 1993 and was declared a terrorist by the government in 2020. He is currently operating from Pakistan and is also the head of the United Jihad Council (UJC), a conglomerate of several terrorist organizations. The NIA had attached properties belonging to Salahuddin and his two sons in 2023. His sons were dismissed from government service in 2021 after their arrest in a terror financing case.
