Mumbai Latest News: A special court in Mumbai has sentenced a 19-year-old youth to two years of rigorous imprisonment for holding the hand of a minor girl and expressing love to her. Judge Ashwini Lokhande of the Special Court of Protection of Children from Sexual Offenses (POCSO) Act said that the words spoken by the accused definitely hurt the dignity of the 14-year-old victim.
The court, in its order passed on July 30, convicted the accused of molestation under the Indian Penal Code (IPC). However, he was acquitted of charges under the strict sections of the POCSO Act.
He had held the hand of a minor who had gone to buy tea leaves
According to the prosecution, the minor girl’s mother had lodged a complaint at the Sakinaka police station in September 2019. The complainant told the police that her daughter had gone to a nearby shop to buy tea leaves, but returned home crying. According to the complainant, on being questioned, the girl told her mother that a boy living on the first floor of the building held her hand and said ‘I love you’ to her.
The accused said – the girl herself called him to meet
The accused defended himself by calling himself innocent and claimed that he had a love affair with the victim and she (the girl) herself called him to meet on the day of the incident. The judge said that it has been proved that the accused used criminal force on the victim when she was going to collect tea leaves.
The judge said that the words spoken by the accused have definitely hurt the dignity of the victim. The girl was 14 years old at the time of the incident. The court said in its order that if the victim had an affair with the accused, then why would she tell her mother about the incident out of fear?
