Delhi HC: High Court reprimanded the case of appointment of a color blind person to the post of driver by Delhi Transport Corporation.

New Delhi: Delhi High Court has strongly reprimanded Delhi Transport Corporation (DTC) for its negligence. The High Court has asked DTC how it appointed a color blind person as a driver and allowed him to drive the bus for three years. Justice Chandradhari Singh said that the matter is very serious as it involves public safety and this ‘negligence’ on the part of DTC is very disappointing. Let us tell you that color blind people are unable to identify colors. It is especially difficult to distinguish between green and red colors.

Court judge expressed regret
Justice Chandradhari Singh, regretting the ‘sorry state of affairs’, asked the DTC chairman to file a personal affidavit after proper investigation and reveal the details of the officer responsible for the recruitment done in 2008. The court passed the order on DTC’s plea relating to the services of a color blind driver who was terminated due to an accident in January 2011. The court has said in its order that “the petitioner authority should have taken appropriate care and vigilance in ensuring that its driver conforms to all the standards for appointment to the said post.” Therefore, this Court now wishes to be cognizant of the fact as to why and under what circumstances the petitioner Department had appointed the respondent without considering public safety as such actions may have a serious impact on public safety.

Certificate was issued during appointment
The court observed, “It is a very appalling situation that the respondent was appointed as a driver in the petitioner department and was allowed to drive the buses of the department for three years from the date of his appointment in 2008 till 2011.” When asked how a person suffering from color blindness at the time of recruitment was appointed as a driver, the court was told that it was done on the basis of a medical certificate issued by the Guru Nanak Hospital. The department also said that more than 100 people suffering from color blindness were employed, which led to the formation of an independent medical board in 2013.
