A delegation of INDIA bloc MPs submitted an impeachment notice against Madras High Court Justice G.R. Swaminathan to Lok Sabha Speaker Om Birla, with 120 signatures. Here’s what the case is about.

All preparations are underway to move for the impeachment of Madras High Court Judge Justice GR Swaminathan in the current winter session of Parliament. MPs from the DMK and the India Bloc submitted a notice of impeachment against Swaminathan to Lok Sabha Speaker Om Birla. The notice was signed by 120 MPs, including Congress leader Priyanka Gandhi and Samajwadi Party chief Akhilesh Yadav.

DMK Parliamentary Party leader Kanimozhi, party leader TR Baalu, Samajwadi Party President Akhilesh Yadav, and Congress General Secretary Priyanka Gandhi Vadra were present in Speaker Om Birla’s chamber when the notice was presented to him. According to the notice, the motion seeks the removal of Madras High Court Judge Justice GR Swaminathan under Articles 217 and 124 of the Constitution of India.

Allegations in the Notice
The notice alleges that Justice Swaminathan’s conduct has raised questions about judicial impartiality and transparency. Swaminathan was also accused of unfairly favouring a senior lawyer and lawyers from a particular community, and claimed that his recent decisions were influenced by political ideology, which was against secular constitutional principles. The motion also included copies of letters sent to the President of India and the Chief Justice of India. The notice alleged that the judge’s conduct had raised questions about judicial impartiality and transparency, accused him of providing undue benefits to a senior lawyer and lawyers from a particular community, and claimed that the decisions were influenced by political ideology, which was against secular constitutional principles.

What’s the matter?
This move comes amid an ongoing controversy over the lighting of the traditional Karthigai Deepam lamp atop the hill in Thiruparankundram. Thiruparankundram is a site with a temple and a nearby dargah. The controversy stems from an order by Justice Swaminathan directing the lighting of the traditional Karthigai Deepam ceremony at a temple on the Thiruparankundram hills in Madurai district. This order sparked a major controversy between political and religious communities. Following this, the DMK has demanded impeachment proceedings against the Justice.

This move by the DMK follows Justice Swaminathan’s recent order directing the lighting of the traditional Karthigai Deepam at the temple located atop the Thiruparankundram hills in Madurai. The court stated that this traditional ritual would not infringe on the rights of the dargah or the Muslim community, but the Tamil Nadu government refused to implement the High Court’s order, citing concerns about law and order. The DMK alleges that such an order by the judge could spark communal tension.

DMK’s Allegation
The DMK alleges that the BJP has created a situation of communal conflict in Tamil Nadu following Justice Swaminathan’s decision. The Tamil Nadu government has approached the Supreme Court challenging the Madras High Court’s order allowing the lighting of Karthigai Deepam at the temple located near the dargah. The Supreme Court on December 5 agreed to hear the Tamil Nadu government’s petition challenging the Madras High Court’s order allowing devotees of the Arulmigu Subramanya Swamy Temple to light the traditional Karthigai Deepam lamp at Deepapathoon, a stone lamppost located near the dargah in Tirupparamkundram.

On December 4, the Madurai Bench of the Madras High Court dismissed an inter-court appeal filed by the Madurai District Collector and the city Police Commissioner and upheld a single judge’s order allowing devotees to light Karthigai Deepam lamps at Kodipathoon. When the order was not implemented, the single judge passed another order on December 3, permitting devotees to light the lamps themselves and directing the Central Industrial Security Force (CISF) to ensure their security.
