A man accused in a murder case has finally received justice from the court after living for 100 years. The Allahabad High Court acquitted the nearly 100-year-old accused in the murder case yesterday, Wednesday. The court stated in its judgment that more than four decades have passed since he challenged his life sentence, and the social consequences he has endured cannot be ignored while granting him relief.
A division bench of Justices Chandra Dhari Singh and Sanjeev Kumar, while pronouncing the judgment, also said that the long pendency of the appeal and the advanced age of the accused, Dhani Ram, were relevant factors in granting relief.
Life imprisonment sentence pronounced in 1984
The case is from Hamirpur district of Uttar Pradesh. The murder took place in 1982 over a land dispute, and three people – Maiku, Satti Deen, and Dhani Ram – were accused in the case. Maiku absconded after the murder, while the Hamirpur Sessions Court sentenced Satti Deen and Dhani Ram to life imprisonment two years later, in 1984.
Dhani Ram was released on bail the same year. While Satti Deen died during the pendency of his appeal, Ram remained the sole surviving appellant in the case.
Prosecution failed to prove guilt beyond reasonable doubt: HC
Noting that Ram has been on bail since then, the Allahabad High Court directed that his bail bond be discharged and also stated that the decision to acquit the accused is based on the merits of the case, particularly the prosecution’s failure to prove the charges beyond a reasonable doubt.
While pronouncing the judgment, the division bench further stated that the anxiety, uncertainty, and social consequences suffered by the accused for decades should not be overlooked when considering what justice demands in this case. Dhani Ram’s lawyer told the court during the hearing that the appellant is approximately 100 years old and had only incited Maiku to fire the gun at the victim.
