Bengaluru: The Karnataka government has issued a notification regarding the new law, taking a tough stand on tobacco. Under this, hookah bars have been banned and the legal age for purchasing tobacco products has been increased from 18 to 21 years. Along with this, the penalty for violation has been increased. The Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade, Production, Supply and Distribution) (Karnataka Amendment) Bill, 2024 was notified on May 30 after getting the President’s assent on May 23.

No use of tobacco in public place
The Act, which bans the use of tobacco products in public places, states that no person shall use tobacco products in any public place. It states that “use” means smoking and spitting tobacco. However, separate provision can be made for smoking area or place in hotels with 30 rooms or restaurants with a seating capacity of 30 or more people and airports.

Ban on hookah bars
Section 4A of the Act prohibits opening or operating hookah bars. It states, “No person shall, on his own or on behalf of any other person, open or operate a hookah bar in any place, whether eatery, pub, bar or restaurant, by whatever name called.” According to the Act, “hookah” bar means an establishment or place where people assemble to smoke tobacco or other similar products from a community hookah or ‘narghile’ which is individually provided.

Punishment and penalty for running a hookah bar
Regarding the punishment for operating a hookah bar, the Act states that whoever violates the provisions of Section 4A shall be punished with imprisonment of a term which may extend to a minimum of one year to three years and with fine which may extend to a minimum of fifty thousand rupees to one lakh rupees.

Selling tobacco to persons below 21 years of age an offence
The Act prohibits the sale of cigarettes or other tobacco products to a person below 21 years of age and in any particular area. No person shall sell or offer for sale cigarettes or any other tobacco product to any person below the age of 21 years. Under sections 21, 24 and 28 of the Act, the penalty for smoking in a public place and selling tobacco to persons of 21 years of age or below has been increased from Rs 200 to Rs 1,000.
