In an important decision, the special court of Gwalior has said that unnatural sex by a husband with his wife does not come under the category of crime. The court has acquitted the accused named Pawan Maurya. The court gave a clean chit to the accused and declared him innocent. This decision was given by Special Judge Vivek Kumar. However, the court has not yet given its verdict on other cases against the accused.
The advocate told that the accused Pawan was married in 2020. Some time after the marriage, a dispute started between Pawan and his wife. After the dispute continued for a long time, the wife lodged an FIR against the husband in Mahila Thana Padav on 25 February 2024. In the complaint, the wife had made many serious allegations against the husband. In the complaint given to the police, the wife said that her husband has unnatural sex with her after drinking alcohol. Not only this, he beats her every day and demands dowry.

In the hearing of the case, the special court considered the allegations leveled against the husband. A case was registered against the accused Pawan under sections like unnatural sex, dowry harassment, domestic violence and assault. The court heard both the sides and keeping in mind the arguments, acquitted Pawan Maurya of the charge of unnatural sex. During this, the court also cited a decision of the High Court.
Hearing on other cases will continue
The court in its order cited the decision given by the High Court in the case of Umang Singhar, Leader of Opposition in Madhya Pradesh Legislative Assembly. The court has remarked that unnatural sex by a husband with his wife is not rape. It cannot be considered a crime. However, the court has said that the trial will continue under other allegations made by the wife. This decision has become a topic of important discussion related to law and justice system in Madhya Pradesh. Many legal experts have different opinions about this.
