Maharashtra: Bombay High Court expressed strong displeasure over non-action against illegal construction on a plot in Navi Mumbai, said whether there is rule of law or muscle power in the state?

The Bombay High Court has expressed strong displeasure over the non-action against illegal construction on a plot in Navi Mumbai, Maharashtra. The court made a strong remark and said whether there is rule of law or muscle power in the state? Along with this, the court reprimanded the government’s town planning agency CIDCO for not being able to remove the illegal construction.

In an order passed earlier this month, a bench of Justice AS Gadkari and Justice Kamal said that the officials of the City and Industrial Development Corporation (CIDCO) are not willing to take strict action against unauthorized construction. CIDCO told the court that when they tried to initiate legal action against illegal structures, the sarpanch of Bokadvira village threatened them.

‘Is there rule of law or rule of muscle power…’

On this, the bench said that the officials are entitled to get adequate police protection while discharging their legitimate duties and it is the duty of the authorities to prevent illegalities and establish the rule of law. During the hearing, the court said, ‘We fail to understand whether we live in a state where there is rule of law or rule of muscle power’. Along with this, the court also said that the threats given by the Sarpanch of Bokadvira village cannot be tolerated at any cost in a democratic country, because CIDCO officials are performing their legitimate duties.

Instruction to demolish illegal construction
Actually the court was hearing a petition filed by a couple in 2016, in which CIDCO was asked to be directed to demolish the illegal construction made by a person named Deepak Patil on their land in Navi Mumbai. The petitioners say that illegal shops have been constructed on their 123 square meter land. The court has directed CIDCO to take all necessary legal steps to remove the illegal construction within a week.
