The Muslim side has challenged the Allahabad High Court’s decision on the Mathura Shri Krishna Janmabhoomi case in the Supreme Court. Shahi Idgah Mosque Trust has filed a Special Leave Petition (SLP) against the High Court’s order in the Supreme Court. The petition states that the High Court’s decision is not appropriate. Along with this, the Supreme Court has been asked to immediately stay the High Court’s order and hold further hearing.
In fact, in the Mathura Krishna Janmabhoomi and Shahi Idgah Mosque case, the Allahabad High Court had rejected the petition of the Muslim side, in which the Muslim side had demanded the dismissal of 18 petitions of the Hindu side. While the Hindu side had demanded the right to worship there in its petition. In such a situation, now the Muslim side has approached the Supreme Court.
The trust will present all the facts in the Supreme Court
At the same time, Ashutosh Pandey of Shri Krishna Janmabhoomi Mukti Nirman Trust Mathura said that he had filed a caveat application even before the Muslim side filed the petition in the Supreme Court, so that a one-sided order is not issued, why Shahi Idgah Mosque has demanded an immediate stay on the High Court’s order in the petition. The trust said that it will present all the facts in the Supreme Court as well, which were given in the High Court.
HC had rejected the petition of the Muslim side
The Muslim side had demanded the dismissal of the petitions of the Hindu side, citing the Places of Worship Act, Waqf Act, Limitation Act and Specific Possession Relief Act in the petition. But the single bench of the High Court rejected the application of Order 7/Rule-11 of CPC of Shahi Idgah Mosque Trust. This decision was given by Justice Mayank Jain Bench and the application of the Hindu side was considered fit for hearing.
The Hindu side had given these arguments
In the petitions filed by the Hindu side in the court, it has been said that the mosque has been built on 13.37 acres of land of Katra Keshav Dev temple. The two and a half acre area of the mosque is the sanctum sanctorum of Shri Krishna. Along with this, it has also been claimed that the committee of the mosque does not have any record of the land. The Hindu side says that the mosque has been built by demolishing the temple. The Muslim side had argued in the court that an agreement was reached between the two parties in 1968, hence it is not right to consider the agreement wrong after 60 years.
