Chief Minister Arvind Kejriwal’s petition against the summons of ED i.e. Enforcement Directorate in the Delhi liquor scam case was heard in the Delhi High Court on Wednesday. On the application of Arvind Kejriwal, the bench of Justice Suresh Kait and Justice Manoj Jain in Delhi High Court asked why are you not appearing on the summons?
In response, senior advocate Abhishek Manu Singhvi, representing Arvind Kejriwal, said that he has no problem, but needs protection. He further said that all the summons of the Enforcement Directorate are not as per the legal procedure and provisions. Let us tell you that ED has asked CM Kejriwal to appear before it on March 21 under the ninth summons.
During the hearing on Arvind Kejriwal’s petition, Abhishek Manu Singhvi told the court, ’10 summons were issued to us by ED. We have filed replies on all. We have said that we are ready to appear before the ED virtually at any time and answer. We have no problem in appearing, but we need some protection. Abhishek Manu Singhvi demanded Delhi High Court to issue notice to ED and said that reply should be sought from ED in this matter.
ED protested
Abhishek Manu Singhvi said that the court should issue a notice in this regard and ask the investigating agency what is their stand on the ground of our argument and opposition? Do political parties come under the purview of PMLA? This issue was discussed in the Supreme Court in the bail case of Manish Sisodia. The matter is pending. At the same time, ASG SV Raju, appearing on behalf of ED, raised questions on Arvind Kejriwal’s petition and said that this petition is not worthy of hearing. We will file a reply on this.
We have no problem in appearing: Kejriwal
ED said that summons was issued to Arvind Kejriwal for the first time on 2 November 23, since then he has not appeared till date. After this the Delhi High Court asked why you are not appearing on the summons. In response to this, Abhishek Manu Sindhvi said that we have been issued 10 summons so far. We filed replies on all. We have said that we are ready to appear before the ED virtually at any time and answer. We have no problem in appearing but we need some protection.
Delhi High Court issues notice to ED
ASG Raju opposed the demand to issue notice on Arvind Kejriwal’s petition. After this the court asked how many people have been arrested so far. ASG Raju said that a total of 15 people have been arrested so far in the case. The last arrest has been made of Kavita, till now a total of 700 summons have been issued, currently 10 to 12 people are suspects in the case. Delhi High Court has issued a notice to ED on the issue of whether Arvind Kejriwal’s petition is hearable or not and has sought a reply within two weeks. The next hearing will now be held on April 22.
