SP Rajya Sabha MP Ramjilal Suman said that the entire law of the Waqf Board is flawed. Government interference in any religion is not justified at any cost. He said that people of the same religion live in the institutions of all religions. In such a situation, it is not right to include non-Muslim people in the Waqf Board. It is not justified at any cost. He instructed, the government should kindly stop interfering in the internal matters of Muslims.
Let us tell you that the Supreme Court on Monday refused to completely stay the Waqf (Amendment) Act, 2025. The court said that any law is considered constitutional and its provisions can be stayed only in rare circumstances. However, the court, while imposing an interim stay on some sections, clarified that it is necessary to be cautious in matters related to the rights of citizens.
This order was pronounced by a bench of Chief Justice Justice BR Gavai and Justice Augustine George Masih. The court had reserved the decision in this case on May 22. While giving the verdict on Monday, CJI Gavai said that there is no basis to ban the entire law, but some sections seem unconstitutional and a ban on them is necessary.
No more than three non-Muslim members will be included in the Waqf Board
The court ordered that the collector will not have the right to decide on disputes of personal property of citizens. An immediate ban was imposed on this provision. Apart from this, an interim ban has also been imposed on the requirement of five years of practice of Islam to do Waqf. The Supreme Court also considered the participation of non-Muslims in Waqf bodies. The court said that no more than three non-Muslim members will be included in the Waqf Board and there will not be more than four non-Muslims in the Waqf Councils.
