Supreme Court on Abbas Ansari Case: The Supreme Court on Friday relaxed the bail condition imposed on MLA Abbas Ansari in a case of Uttar Pradesh Gangster Act, allowing him to stay at home in Ghazipur during his visit to his constituency Mau.
A bench of Justices Surya Kant and N. Kotishwar Singh of the Supreme Court, taking the confidential report of the Uttar Pradesh government on record, amended the order of this court dated March 7. In the order of March 7, several conditions were imposed on Abbas Ansari, son of late gangster Mukhtar Ansari, for bail.
UP government raised questions on Abbas Ansari not appearing in court
Additional Solicitor General KM Nataraj, appearing for the Uttar Pradesh government, told the apex court that Abbas Ansari has not been appearing in the cases against him for the last two-three dates. To this, Justice Surya Kant said that the restrictions imposed on him could be the reason for this.
Senior advocate Kapil Sibal, appearing for Ansari, told the bench that in the last six months, the MLA has neither come out of his Lucknow government residence nor has gone to his constituency.
Kapil Sibal appealed to the court on behalf of Abbas
Sibal said on behalf of his client, “My Mau constituency is 350 km from Lucknow. How can I go to my constituency and return the same day? My house in Ghazipur is just 40 km from the constituency, please allow me to stay there during my constituency tour.”
Court gave instructions to Abbas Ansari
The bench allowed Abbas Ansari to stay for three consecutive nights during his visit to his constituency, but banned him from attending any political meeting during his stay. The Supreme Court bench also allowed Abbas Ansari to file a reply on the status report filed by the state government.
Abbas Ansari has previously got bail in several criminal cases
On March 7, the apex court had granted six weeks interim bail to Abbas Ansari in this case and asked him to stay in his official residence in Lucknow and seek prior permission from the authorities before visiting his constituency in Mau. The bail in this case has cleared the way for Abbas Ansari’s release from Kasganj jail, as he was already on bail in other criminal cases registered against him.
Was arrested under Gangster Act last year
The apex court had sought a confidential status report from the police in 6 weeks on compliance of bail conditions by Abbas Ansari, barring him from speaking publicly on pending cases. Abbas Ansari was taken into custody on November 4, 2022 in other criminal cases and arrested under the Gangster Act on September 6, 2024.
Accused of extortion and assault
An FIR was lodged on August 31, 2024 at the Kotwali Karvi police station in Chitrakoot district against Abbas Ansari, Navneet Sachan, Niaz Ansari, Faraz Khan and Shahbaz Alam Khan under sections 2 and 3 of the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986. They were accused of extortion and assault.
