The MP/MLA court in Rae Bareli will hear the petition regarding Rahul Gandhi’s citizenship again today. Judge Vivek Kumar recently heard the petition filed by Bengaluru resident S. Vignesh Shishir, setting the next date for December 12th.
The petition also names the Election Commission, the Enforcement Directorate (ED), the Income Tax Department, the Rae Bareli Returning Officer, and the Lok Sabha Speaker as respondents. The Lucknow bench had previously dismissed the case because the central government had failed to submit a definitive report on Rahul Gandhi’s citizenship. At that time, the court stated that the petition could not remain pending forever and allowed the petitioner to approach another legal forum if necessary.
The court also directed that any report received be shared with the petitioner and filed in the court. In 2019, the Supreme Court dismissed a similar petition, stating that Rahul Gandhi was an Indian citizen. This issue also arose during the 2024 Lok Sabha elections, when a petitioner claimed that Rahul Gandhi had described himself as a “British citizen” in the documents of a company in the UK (Backops Services Private Ltd.).
What is the whole matter?
After winning the 2024 election from Rae Bareli, a petitioner claimed that Rahul Gandhi had lied about his citizenship in the election affidavit, which could be grounds for disqualification under Section 84 of the Indian Constitution. Following this, on December 3, 2025, Bengaluru-based BJP leader S. Vignesh Shishir filed an application in the MP-MLA court in Rae Bareli.
The application sought the registration of an FIR against Rahul Gandhi. Vignesh Shishir is demanding that a case be filed against Rahul Gandhi under sections 61, 147, 148, 152, 236, 237, 238, 318, 335, 340, 336, 351, 354, 359, and 241 of the Indian Penal Code (IPC), as well as various sections of the Passport Act and the Foreigners Act.
What is the Congress’s stance?
Congress leaders are denying all these allegations and calling the petition a conspiracy to harass Rahul Gandhi and the opposition. If the court orders the registration of an FIR in today’s hearing, it will be considered a major blow to the Congress.
