The 130th Constitutional Amendment Bill was introduced during the monsoon session of Parliament, which has created a political uproar. It has been sent to a joint committee of Parliament. While the government is calling this bill in the interest, on the other hand the opposition parties have come out in opposition to it. This is the reason why now the Trinamool Congress has called the JPC a tamasha and has decided not to join it.
On Saturday, Trinamool Congress Rajya Sabha MP O’Brien said that his party and the Samajwadi Party have decided not to join the JPC. The Union Territory Government (Amendment) Bill 2025, the Constitution (One Hundred and Thirtieth Amendment) Bill 2025 and the Jammu and Kashmir Reorganization (Amendment) Bill 2025 were introduced in the Lok Sabha on Wednesday. They have been sent to a joint committee of Parliament.
JPC is a kind of tamasha – TMC MP
Trinamool Congress MP O’Brien said that his party and the Samajwadi Party have decided that they will not send any member to the JPC. He further said, “We oppose the 130th Constitution Amendment Bill which is still in the proposal stage and in our view the JPC is a farce. The proposed bill provides a legal framework for the removal of the Prime Minister, Chief Ministers and Ministers if they are arrested for 30 consecutive days on serious charges.
Opposition parties trying to convince SP and Trinamool Congress
The Samajwadi Party has not officially said anything about not going to the JPC, but party leaders have indicated that they will not join the JPC.
However, a section of the opposition is talking about going to the JPC. In view of this, some parties said that we are trying to convince the SP and Trinamool Congress. A leader said, “If they go, then more MPs of BJP and NDA will become part of the JPC. There will be no benefit from this. ”

O’Brien has described the NDA alliance as “weak” in his post on ‘X’. He said, the entire monsoon session, the Modi alliance with 239 seats has been on the defensive. On TMC’s refusal to join JPC on Constitution (130th Amendment) Bill, Leader of Opposition in West Bengal Suvendu Adhikari said, “This (TMC) is a party of thieves, a family-run party. More than half of their ministers have either gone to jail or are about to go. Due to fear, they know that this bill will have a deep impact on them, so naturally they will oppose it.
He said that the people of the country support this bill. The law of this country should be equal for everyone. The Prime Minister wants to bring reforms in this direction and the whole country is with him. If someone officially opposes it, then the message will go to the public that TMC is opposing this bill to save its ministers, chief minister and leaders. Elections are going to be held in Bengal in a few months, so they are deliberately not joining (JPC).”
What is the bill that is being opposed
During the monsoon session of Parliament on Wednesday, 20 August 2025, Union Home Minister Amit Shah introduced the 130th Constitution Amendment Bill in the Lok Sabha. These bills will not be passed for the time being, but will be sent to the Select Committee of Parliament so that every aspect of them can be discussed in detail. Along with this, everyone’s consent and objection can also come to the fore.
When this bill was introduced in Parliament, there was a lot of uproar from the opposition. The opposition alleges that this is a way of dictatorship. With this, they will put anyone in jail. According to the government, its purpose is to give a new dimension to the accountability and morality of the ministers.
According to this bill, if any Union or State Minister, or even the Prime Minister or Chief Minister is arrested in a criminal case, which can lead to a minimum of five years in jail and he is kept in custody for 30 consecutive days, then in such a case he will be removed from the post on the 31st day. Till now there was no such clear rule regarding resignation. If the minister is acquitted by the court, he can return to his post again.
