The court has announced the death sentence for the accused in the case of rape and murder of a minor in Kultali of South 24 Parganas district of West Bengal. On Friday, after about 2 hours of questioning, the judge of Baruipur POCSO court sentenced Mustkin Sardar to death. He was convicted in this case on Thursday. The court announced the sentence after just 62 days.
While being taken to the court on Friday, looking towards the media, he said, “I have not done anything.” “I have been framed.” “Who has framed me?”, Mustkin said, “The party has framed me.” Later, a 2-hour round of questioning took place in the court. The public prosecutor demanded death penalty.
The incident happened in October
The incident happened last October. There was an uproar over the RG Kar case. At the same time, the matter had heated up in South 24 Parganas over the death of a minor. When the body of a minor girl was recovered after a night-long search, rape and murder charges were filed. The locals were angry that day. The police had to struggle to control the situation.
Under the POCSO Act, the courts have awarded death penalty in murder cases and rape-murder cases. Life imprisonment has been ordered for kidnapping and seven years for tampering with evidence. The court announced the sentence 61 days after the incident. There were a total of 36 witnesses in this case.
Charge sheets were filed on October 30
The minor was missing on the night of October 4. The police recovered the body at night. The accused was arrested soon after. The next day, i.e. on October 5, the accused was produced in the Baruipur court. On October 7, an SIT was formed to investigate the incident. Exactly 23 days after the formation of the SIT, i.e. on October 30, the charge sheet was filed in the Baruipur court.
Testimony begins 6 days after the charge sheet is filed. A month later, on December 5 (Thursday), the accused Mustakin Sardar was found guilty by the Baruipur POCSO court.
Mamata said this after the court’s decision
After the court’s decision, state CM Mamata Banerjee said that in the case of brutal rape and murder of a minor girl in Jayanagar on October 4, the accused has been sentenced to death by the POCSO court of Baruipur today within just 62 days of this heinous incident. Conviction and death sentence in such a case within just two months is unprecedented in the history of the state.
She said that I congratulate the state police and all those involved in the prosecution process for this outstanding achievement. The government has zero tolerance towards crimes against women and will continue to ensure that justice is neither delayed nor denied.
